On the agenda, under Public Discussion, it was called “Hazardous waste incinerator,” and it’s freaking out some residents of the New Milford and Harford areas.
A privately-held outfit called “Tyler Corners, LP” is proposing to establish an “industrial park” on 114 acres at the Gibson exit on Interstate 81 that might include “an industrial waste incinerator facility” according to a document offered by the developer and available on its (minimal) website at www.tylercorners.com, which also vows transparency. Some citizens of the area are mobilizing to stop the project in its tracks, well before anything is likely to happen on the property, claiming lack of just such transparency, and they have established a Facebook page, “Stop Susquehanna County Waste Incinerator” to that end. Some say that transfer of the property is imminent. The county Planning Commission Director, Robert Templeton, in a report in April said that construction probably wouldn’t begin until 2018. Commissioner Alan Hall, trying to attract business and employment to Susquehanna County, has characterized much of the talk about the project as “speculation,” noting the lack of specific information.
That wasn’t stopping a group of concerned citizens, led by Dale Ferger, who visited the Harford Township Supervisors’ meeting on June 21st. Mr. Ferger distributed a flyer about their fight, and asked that the Supervisors collaborate with their counterparts in neighboring municipalities to address the problems – environmental and otherwise - that they fear will arise with the operation of such an incinerator in their community. Supervisor Conrad Owens voiced support for the opposition to the facility. His colleague, Doug Phelps, demurred, saying he was uninformed on the issue; but he pledged to find a venue for a “town hall meeting” in Harford – perhaps at the firehall on June 29 at 6:00pm – to hear more. There has already been a public meeting on the project in New Milford, as well as discussions by the New Milford Township Supervisors. The site in question is located in New Milford Township. Harford Township still belongs to the Susquehanna County Council of Governments (COG), which used to provide building and sewage permitting services in Harford. None of the Supervisors would admit to having ever attended a meeting of COG, and COG is not known to have made a statement on the issue.
The protracted discussion of the incinerator actually came at the very end of the Supervisors’ meeting. There was other business.
An attorney was expected to appear to help finalize the loan with Peoples Bank & Trust to support the renovation of the sewer system. He didn’t show, but the Supervisors voted anyway on a motion by Sue Furney to approve the loan so that they could sign the paperwork when it arrives.
The Supervisors opened 3 bids on a project to refurbish the section of White Road from Grinnell to Three Lakes. The contract was awarded to Ken Rauch Excavating of Montrose for the low bid of $79,439. The award is contingent upon notice that the DSA material to be used to top the completed road surface would be provided by a state-certified (Dirt & Gravel Roads Program at Penn State) source, of which there are only two known in the county.
They also opened bids for trucking and “placement” of 3,800 tons of DSA in 4 other locations around the township. Barhite Excavating won the contract at a price of $7.58 per ton. Proper “placement” of the “driving surface aggregate” requires the use of paving equipment and produces a hard, near-paved result.
The Supervisors discussed plans for ditching work around the township, but held off any decisions while Mr. Owens computes the number of feet of ditches needing the most work in priority order. Specifications will then be developed for soliciting bids. Upper Podunk Road, Beaver Meadow, and North Harmony Road were mentioned as possibilities this year. In the meantime, Roadmaster Jim Phelps asked for and received authorization to spend $3,000 to fix the worst ditches on North Harmony and Three Lakes Roads. Barhite Excavating was the only one of 3 outfits contacted that offered a quote for the work.
Stevens Road is a perennial favorite at Supervisors’ meetings, especially in the summer when dust becomes a serious problem. Stevens Road may also come in for some ditch work, but residents along the wide and dry section at the Kingsley end are most concerned about dust, and what the Supervisors intend to do about it. Salt brine doesn’t seem to be doing much, so the Supervisors will ask for bids to supply oil (probably the so-called AEP oil); bids are to be made by price per gallon. An oiled surface can be expected to last 1-2 years at most.
The Supervisors adopted a new fee schedule from the JHA Companies. JHA (aka Joe Hunt & Associates) provides building and sewage permitting services, along with general engineering consulting, to the township. Township Secretary Carolyn Jennings said that some charges remained the same, while others had increased “slightly.”
Roadmaster Phelps also asked the Supervisors to consider hiring another full-time worker for the road crew. He said that all the work around the township just couldn’t be properly done by the 2 full-time and 2 part-time people now available. The township will look for someone with a commercial driver’s license (CDL) as an equipment operator and laborer.
It may have been last on the agenda, but it was Mr. Ferger’s effort to stop the incinerator that dominated the meeting. “Do you think this is a worthwhile cause?” he asked, prodding the Supervisors and his fellow citizens to take action. The movement is gathering steam and residents are encouraged to inform themselves.
The next public meeting of the Harford Township Supervisors is scheduled for Tuesday, July 19, 2016. All meetings of this sort are held in the Township office on Route 547, and begin at 7:00pm. The office is small, so get there early for a seat.
The June 15th New Milford Township meeting was standing room only, with people lining the sides and back of the room, in addition to those who arrived early enough for a chair. There was a sign on the door relating that the doors would open at 7 pm and by shortly after that time, there was already an impressive number of attendees for a meeting regularly attended by the supervisors, staff, press and, at most, a few visitors. The number of attendees wasn't the only anomaly. When there isn't controversy within the township's borders, the meeting regularly lasts between fifteen minutes and a half an hour. That Wednesday, it ran much closer to an hour and a half.
This was the second month in a row where a proposed incinerator swelled the public ranks. However, the crowd on the 15th appeared larger even than the month previous and the volume within the room was louder as well. The size of the crowd may have been representative of a speaker at the previous night's informational session urging those in attendance to visit the township meeting. Before the meeting began Ms. Graham, the borough's secretary, spoke up explaining to those present that if they wished to speak they had to sign in and that each speaker was to get only two minutes.
When the meeting actually did begin, Mr. Shibley made the announcement that should the meeting get out of hand at any point the supervisors would adjourn it and reconvene the following month. The supervisors then proceeded to deal with the regular township business prior to broaching the subject most were waiting for. Mr. Shibley related that the township had tabled bids for the garage the previous months and as they were still waiting for engineered plans from Todd at Fox Engineering, the matter as to be tabled again. In other bid news, only one bid for guidrail was received, from Chemung Supply. As such, Mr. Conroy made the motion to go with that company.
An update was given regarding the Pentagon Gas project. A spokesperson had stated, earlier in the day, that the property was officially purchased and that the company was enthusiastic about the project being a go. The company was waiting on permits from the state of Connecticut with regards to transport and once they were issued, planned to proceed with the permitting process within the township.
The Emergency Management Coordinator, Mr. Bondurant announced that he had gone on a tour, along with county emergency management, of the compressor station on East Lake Road. DTE had taken them trough the facility.
The supervisors then reviewed several informational points, which they stated was what they knew about the incinerator. These points were also written out on the agenda. The Tyler Corner's Group had attended a luncheon with Commissioner Alan Hall, Planning Director Bob Templeton and others to discuss informal plans and the associated economic benefits. They had not had any further correspondence with said group of participants since. The dates and times were not given.
The Tyler Corner's group had met with two representatives from DEP for an informal information session. They did not particpate in a pre-application meeting which was part of the formal application process, nor had they submitted any formal plans for permit applications to the DEP. They had not had any further correspondence with DEP. Information regarding this matter was verified by a supervisor in the waste management department at DEP, it was asserted.
The Tyler Corner's group was waiting on title clearance for the proposed site; this was anticipated to clear on or before June 25th. The group did not have any formal or engineered plans for the site or facility as of that date and would not pursue preparation of such until the title cleared.
A partner of the group had reached out to the township that day. He said that a legal representative for the Tyler Corner's Group was to be sending a letter of intent about the project to the supervisors within the next few business days. The group anticipated that they would be prepared to make full disclosre of the project, in its entirety, within 60 to 90 days. At that time they planned to both schedule a public workshop and to appear at a regularly scheduled township meeting. They also planned to create a website with information and to have a direct phone line accessible to the public.
The group wished the public to know that they planned to develop all of the property, bringing in all necessary utilities in order to provide a sound infrastructure for a modern, well maintained industrial park. Other types of businesses, aside from the incinerator, to be included in the development had not yet been decided.
The incinerator itself, the company stated, would provide 100 full time job opportunities (or more). It would follow regulations by the EPA and DEP, and would have a state of the art monitoring system built into the facility itself. The air quality would be tested regularly.
The group said that they wished to be a good corporate neighbor. They planned to provide full disclosure and to abide by all laws and regulations.
The meeting was then opened up to the public. Vera Scroggins, with her ubiquitous camera present, was the first to speak. She asked if this was the first time the group had reached out to the supervisors; it was replied that it was. She asked why the public wasn't given the name of the company contact. Ms. Graham related that the man, who only identified himself as Tim, said he was part owner of the group. Ms. Scroggins asked if the only thing the township could approve with the property was the driveway permit. Mr. Conroy responded that if it was on a state road, the supervisors weren't responsible even to approve that. Ms. Scroggins asked if there was anything else they had to approve. Mr. Shibley said that they might have a say in the sewer.
The next woman called said she gave “Mike” her time. Several other people echoed this sentiment.
Not all of the visitors gave up their time however, asking questions and expressing opinions (mostly a desire to avoid the incinerator). It was confirmed that the township did not have any zoning restrictions. When the questioner asked why this was the case, it was responded that the topic of zoning had been brought up years ago, with 300 people in the room and they did not want it at that time.
The supervisors were asked if any of them had attended the meeting the night prior, but they had not. A man asked if this came before the supervisors, would approve or deny it? The supervisors responded that they needed to find out more information, though Mr. Shibley did state that he didn't want an incinerator in his backyard.
There was again some discussion regarding responsibility. Commissioner Hall had pretty much put the matter on the township at the previous night's meeting, it was said.
Someone asked what procedure was necessitated to pass ordinances. Ms. Graham replied that it had to go through the solicitor and needed to be advertised a certain number of times, a certain number of days apart.
A man asserted that there was no monitoring system at the state or local level that monitored nano particles. He said these would be released by the hundreds or millions.
A woman asked about a bulding permit, wondering how they could go about the project without a building permit. Mr. Shibley responded that he thought the buildings proposed would come under commercial, which would go under labor and industry, under the state. He said they could ask their building inspector about it.
There was some discussion regarding whether an ordinance at the local level would be superceded by an ordinance at the county level. It appeared that the matter was not entirely clear cut.
A supervisor from Herrick Township was present, though not necessarily in offical capacity. He felt that relying on DEP to stop the incinerator was a false hope and related that it was unrealistic to think the facility would operate as advertised, either when it opened or in the future. As a supervisor himself, he said he would pass an ordinance to stop it.
Various people spoke, with various levels of passion, about the detrimental effects of the project. One business owner suggested that with the abundant natural gas in the area, they could seek out and choose an industry to try and bring in. This man also noted that the supervisors had his respect for their hard work on the people's behalf. Mr. Shibley said that the community knew more of the matter than the supervisors did, and they were trying to catch up, trying to learn.
Mike Ewall spoke in time, cashing in on the donated time of others. He thanked the supervisors, and explained that he was with Energy Justice Network, and that he had been working for the past 26 years across the country on environmental matters. He asserted that any kind of incinerator could put out negative byproducts. He talked about the need for continous emissions monitoring and suggested this was one thing they could do with an ordinance. If the standards were set strict enough, he felt that the company would go elsewhere. He had drafted an ordinance for them, which could require the company to have the most angelic incinerator ever. They wouldn't need zoning for that. The best time to act, he asserted, would be the present.
A woman asked if they could vote the ordinance in that night. It was related that they could not, as it would need to be advertised and the supervisors would want it to go to their solicitor first.
Ms. Graham argued with Mr. Ewall's assertion that there were 10 commercial hazardous waste incinerators in the country. She said her research had unearthed 22, using this to demonstrate that they were doing their own research.
A visitor asked if the township could find money in it's budget to pay Mr. Ewall for his time. Ms. Graham related that the township's legal fees to its own solicitor were $850 for two weeks. She noted that the township had not hired Mr. Ewall.
A visitor suggested that the township use impact fees to fund a study. It was responded that there were only certain things a municipality could use these funds for.
Near the end of the meeting, there was talk of how this matter would effect others outside of the township. It was suggested that visitors speak with their own municipalities about the matter.
