Commissioners Meet

The Commissioners met September 28 in the Lower Conference room in the County Office Building. Present were Commissioners Warren, Allen and Giangrieco. They motioned and approved the minutes of the September 14, 2011 meeting.

They motioned to ratify or approve a total of $472,929.00 from September 15, 2011 through September 29, 2011 as follows: they motioned to ratify total Expenses of $393,643.00 of which $139,948.00 is allotted to General Expense, $80,476.00 for CYS Expenses, $1,456.00 for Jury Expenses, and $171,763.00 for Payroll Expenses.

They motioned to approve EFTPS payments of a total $79,286.00 in the following: $14,956 for Employee Retirement Contributions, $7,415.00 for State Withholding taxes, and $56, 915.00 for Federal Payroll taxes.

They motioned to approve the following seminar requests and/or payment of requests from October 25, 2011 through November 4, 2011, with zero cost to the County with the following: Lisa Vail, Probation, Scranton, Battling the Bully, total cost $143.00; Sami Bourizk, Probation, State College, Supervision and Monitoring of Juvenile Sex Offenders, total cost $531.00; John Lester, Probation, Harrisburg, total cost $705.00,

They motioned to accept resignations or hiring's. They accepted, with regret, the resignation of the following: Ruth Smith, Children & Youth, per the recommendation of Susan Adamec, Agency Director, Kenneth Kiefer; and Paul Johnson, 911 Dispatcher Trainees per the recommendation of Art Donato, 911 Coordinator, James Brewer, per the recommendation of Jen Hibbard, Recycling Coordinator.

They motioned the hiring of Ruth Smith, by Treasurer Catherine Benedict, Range 10, Rate $9.80 per hour, 35 hours per week with a six month probation period; Nicole Price, Hallstead, Todd Donohue, New Milford, and Eugina Welch, Montrose to the open full-time position of Dispatcher Trainee, Rate $9.25 per hour, 40 hours per week, with a six month probationary period per the recommendation of Art Donato; and Paul Johnson, Montrose, to the open, full-time position of Emergency Management Operations/Training Officer, $25,000.00 per year, 40 hours per week, with a six month probation.

They motioned to accept the proposal from MCM Consulting Group, Inc, Mc Murray, PS, to prepare a propagation study for wide band radio frequency for $4,320.00. The County must change to narrow banding by the end of 2012.

They motioned to authorize the Commissioners to sign the Children & Youth Needs Based Budget for the year 2012/2013. The total budget amount is $3,473,478. The county portion of that amount is $753,499.00

They motioned to ratify the acceptance of the scope of work and fee for a consultant from Blackbaud to be at the site at the County for 40 hours to identify outstanding issues with Financial Edge and provide solutions and alternative methods of use for $7,200.00.

They motioned to ratify the signing of the contract between Constellation Energy, Baltimore, Md., and Susquehanna County whereby Susquehanna County will purchase electricity from Constellation Energy for a period of one year through Penelec.

They motioned to exonerate the Tax Claim Bureau from collecting delinquent taxes and/or removing from the Repository Sale list on the following, per the recommendation of Catherine Benedict, Tax Claim Director - Lathrop Twp., name of Jim Hodge formerly Brian Schmidt c/o Tax Claim Bureau, consisting of a trailer assessed at $1,000. Trailer was exonerated from rolls by Assessment as removed. Total to be exonerated is $0.00.

The motioned to accept the bid from Knowlton & Sons Masonry, Clifford, to re-point the Courthouse steps and replace a limited number of bluestones at the entrance for $1,850.00.

There was some public comment concerning a motion as Bureaucracy problem concerning funding. The motion was to help make better communication during emergencies. Congressman Thomas Marino is doing his best to resolve this problem.

The meeting closed at 9:29 a.m.

Sentencing Report

Following is the Susquehanna County sentencing report for September 2011 as submitted by the county District Attorney’s office.

William Fassler, 51, of Denver, CO to 30 days to 6 months in Susquehanna County Correctional Facility, with credit for 21 days, supervision may be transferred to Denver County, Colorado upon being granted parole, pay $750 fine, pay cost of prosecution, pay $100 CAT Surcharge, pay $10 EMS, pay $100 Act 198, successfully complete the Alcohol Highway Safe Driving School Program, be subject to the Pennsylvania Ignition Interlock Law for Driving Under the Influence in Montrose Borough on November 20, 2010. Mr. Fassler was also sentenced to pay $150 fine and pay cost of prosecution for Harassment in Montrose Borough on November 20, 2010.

James Theobald, 28, of Susquehanna, PA to 18 months probation, pay $250 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, take prescribed medications, not to possess firearms or offensive weapons for Forgery in Great Bend Township on February 7, 2011.

Vern Raymond Hunsinger, 33, of Montrose, PA to 30 days to 6 months in Susquehanna County Correctional Facility, pay $750 fine, pay cost of prosecution, pay $100 CAT Surcharge, pay $10 EMS, pay $100 Act 198 fee, complete alcohol highway safe driving school program, subject to Pennsylvania Ignition Interlock Law, not to consume alcoholic beverages, complete 25 hours of community service for Driving Under the Influence in Rush Township on March 3, 2011.

David Shawn Blaisure, 32 of Springville, PA to 16 days to 12 months in Susquehanna County Correctional Facility, served on weekends, pay $300 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, write a letter of apology, maintain employment, not to have contact with anyone on supervision for Flight to Avoid Apprehension in Springville Township on March 7, 2011.

Joshua Ryan Whitehead, 25, of South Montrose, PA to 7 months to 2 years minus 1 day in Susquehanna County Correctional Facility, followed by 3 years probation, pay $350 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, subject to DNA testing requirements and pay $250 DNA testing fee, not to possess any weapons or firearms, not to possess, transport, or consume alcoholic beverages, not to enter any bar, tavern or establishment whose principal purpose is the sale of alcohol, not to use controlled substances without a valid prescription, subject to random drug and alcohol screenings, pay restitution to victims, not to have contact with the victims in this case, not to have contact with anyone on supervision for Receiving Stolen Property in South Montrose on May 7, 2011.

Wayne C. Greene, 49, of South Montrose, PA to 11 months to 2 years minus 1 day in Susquehanna County Correctional Facility, followed by 3 years probation, pay $300 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, pay restitution to the victim in this case, perform 25 hours community service for Theft by Deception in Dimock Township on July 1, 2011.

Dominic Gerhardt, 19, of Montrose, PA to 8 months to 23 1/2 months in Susquehanna County Correctional Facility, pay $250 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, receive a sexual offender evaluation and receive counseling if deemed necessary, continue with mental health counseling, take prescribed medications, not to have contact with the victim, not to have contact with minors without adult supervision for Corruption of Minors in Susquehanna Borough on April 1, 2011.

James Robert Davis, 47, of Binghamton, NY to 6 months to 4 years in a state correctional facility, followed by 1 year probation, pay $500 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, pay restitution to the Crime Victims Assistance Program, comply with Megan’s Law requirements, not to have contact with the victim, not to possess any weapons, subject to DNA testing requirements and pay $250 DNA testing fee, not to be around children under the age of 18 without adult supervision for Indecent Assault in Great Bend from 1996 to 1998.

John Paul Bennett, 54 of Montrose, PA to 6 months to 23 months in Susquehanna County Correctional Facility, followed by 18 months probation, pay $300 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, pay $100 Act 198, subject to DNA testing and pay $250 DNA testing fee, not to possess firearms, continue with outpatient for Possession with Intent to Deliver in Dimock Township on February 11, 2010.

Kevin Patrick Jenkins, 21, of Montrose, PA to 4 months to 23 months in Susquehanna County Correctional Facility, followed by 1 year probation, pay $350 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, pay restitution to the victim in this case, pay restitution to Encompass Insurance, not to have contact with codefendant, not to have contact with the victim, receive drug and alcohol treatment for Theft by Unlawful Taking in Montrose Borough on January 31, 2011.

Stewart John Davis, 67, of Clifford, PA to 4 years probation, pay $500 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, subject to DNA testing requirements and pay $250 DNA testing fee, be evaluated and receive treatment for Sexual Offenders, not to possess any firearms, not to have contact with minor children without adult supervision for Child Pornography in Clifford Township on April 6, 2010.

Raymond Richard Haynes, Jr., 22, of Susquehanna, PA to 6 months probation, pay $300 fine, pay cost of prosecution, pay $50 CAT Surcharge, pay $10 EMS, pay $100 Act 198 fee, complete alcohol highway safe driving school program, continue with drug and alcohol counseling, pay restitution to the victim for Driving Under the Influence in Great Bend Township on March 12, 2011.

Justin T. Giberson, 27, of Tunkhannock, PA to 18 months probation, pay $350 fine, pay cost of prosecution, pay $100 Act 198, pay $50 Criminal Justice Enhancement Act fee, receive drug and alcohol counseling, not to possess weapons for Possession with Intent to Deliver in Auburn Township on October 18, 2010.

Annessa E. Shane M. Hildebrandt, 23, of Montrose, PA to 9 months to 23 1/2 months in Susquehanna County Correctional Facility, pay $500 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, subject to DNA testing requirements and pay $250 DNA testing fee, not to possess weapons or firearms, pay restitution to the victim in this case, not to have contact with the owner of Smart Choice Tobacco or the clerk who had been on duty the time of the indecent, not to have contact with the codefendant, not to have contact with anyone on supervision, complete drug and alcohol requirements for Robbery in Little Meadows on January 23, 2011.

Lastly, Mr. Wright received 2 years probation to run concurrent to the above sentences, pay $350 fine, pay cost of prosecution, pay $50 Criminal Justice Enhancement Act fee, not to possess firearms or offensive weapons, maintain employment, not to have contact with the victim in this case, not to have contact with codefendants for Criminal Trespass in Great Bend Township on October 27, 2009.
